Violations of Fair Debt Collection Practices Act

The rules are very specific regarding how Debt Collectors can pursue money they are owed. There are a number of these collectors that don't follow the rules. If you are harassed in any way by a debt collector, you may be able to seek damages for their violations. Federal law mandates that a successful lawsuit that is brought against a debt collector that has broken the rules is $1,000 per violation of the FDCPA and they will be forced to pay for your attorney's fees.

Some of the violations of the FDCPA are:
  • Contact family members or family.
  • Failing to give certain statutory notices that are required by the FDCPA.
  • Threatening to sue you on a debt that has passed the statute of limitations.
  • Threatening to take actions which are not legally available to the debt collector.
  • Requiring you to defend a lawsuit in a county where you do not reside.
Attorney Talley Gray is authorized to practice in Georgia at both the federal and state level and will aggresively pursue your claim under the FDCPA.
